1. Acceptance of Terms

By creating an account or using Polyform (the "Service"), you ("User" or "you") acknowledge and agree to these legally binding Terms of Service ("Terms"). You also agree to our Privacy Policy, which is incorporated by reference.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you have the authority to enter into these Terms.

2. Description of Service

Polyform is a form builder platform that allows users to create, customize, and share forms, surveys, and polls. Our Service includes:

  • Form creation with multiple question types
  • AI-powered form generation
  • AI-powered theme generation
  • Form response collection and management
  • Analytics and insights
  • Team collaboration features

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your password
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Each user must maintain an individual account with unique login credentials. We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Subscriptions and Payments

Some features of the Service require a paid subscription. Payments are processed securely through Polar. By subscribing, you agree to the following:

  • Billing: You will be billed in advance on a recurring basis (monthly or annually, depending on your plan).
  • Auto-Renewal: Your subscription will automatically renew unless you cancel before the renewal date.
  • Payment Method: You must provide a valid payment method and authorize us to charge it for subscription fees.
  • Fee Changes: We may modify subscription fees with reasonable notice. Changes will take effect at the start of your next billing cycle.
  • Refunds: Payments are generally non-refundable. Refund requests may be considered on a case-by-case basis at our sole discretion.

If payment fails, we may suspend your access to paid features until payment is received.

5. Free Trial

We may offer free trials of paid features. At the end of the trial period:

  • Your subscription will automatically begin unless you cancel before the trial ends.
  • We will notify you before your trial expires.
  • Pro features will be removed from your forms if you do not subscribe.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Create forms for illegal, fraudulent, or deceptive purposes
  • Collect personal information without proper consent
  • Send spam or unsolicited communications
  • Distribute malware, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers connected to it
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for competitive analysis or to develop competing products
  • Impersonate any person or entity
  • Post content that is hateful, harassing, defamatory, obscene, or otherwise objectionable
  • Collect data about other users without their consent
  • Create, distribute, or collect pornographic, sexually explicit, or adult content
  • Post content that is harmful to minors
  • Promote violence, terrorism, or illegal activities

We reserve the right to investigate violations and take appropriate action, including suspending or terminating your account and cooperating with law enforcement.

7. User Content and Forms

You retain ownership of the content you create using our Service ("User Content"), including forms, questions, and configurations. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, and display your User Content solely for the purpose of providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate any laws or infringe on third-party rights
  • Your User Content does not contain material that is harmful, fraudulent, or misleading

We do not verify the accuracy, completeness, or suitability of any User Content. We may remove User Content that violates these Terms or is otherwise objectionable.

8. Form Respondent Data

When you collect responses through forms created with our Service, you are the data controller for that information. You are responsible for:

  • Obtaining appropriate consent from respondents
  • Providing privacy notices as required by law
  • Handling respondent data in compliance with applicable data protection laws (such as GDPR)
  • Responding to data subject requests from respondents

Polyform acts as a data processor for form response data and processes it on your behalf according to your instructions. We are not responsible for the content of your forms or how you use the data you collect.

9. Intellectual Property

The Service and its original content (excluding User Content), features, functionality, and branding are owned by Polyform and are protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Use our trademarks or branding without prior written permission
  • Copy, modify, or create derivative works of the Service
  • Remove any copyright or proprietary notices from the Service

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation or compensation to you.

10. AI-Generated Content

Our Service includes AI-powered features for form generation and theme generation. You acknowledge and agree that:

  • AI-generated content is provided "as is" without warranties of accuracy or suitability
  • You are responsible for reviewing and editing AI-generated content before use
  • You own the forms and themes generated through our AI features
  • We are not liable for any issues arising from your use of AI-generated content

11. Third-Party Services

The Service may contain links to or integrate with third-party websites or services. We are not responsible for the content, privacy practices, or availability of these third parties. Your interactions with third-party services are solely between you and the third party.

12. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance
  • Unplanned outages or technical issues
  • Factors outside our control

We are not liable for any loss or damage resulting from Service unavailability.

13. Termination

Your Right to Terminate: You may cancel your account at any time through your account settings or by contacting us.

Our Right to Terminate: We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms
  • Your conduct is harmful to other users or the Service
  • We are required to do so by law
  • For any other reason at our sole discretion

Effect of Termination: Upon termination, your right to use the Service will cease immediately. You may export your data before termination. We may delete your data after termination in accordance with our data retention practices.

Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, and indemnification.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYFORM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR DATA

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

16. Indemnification

You agree to indemnify, defend, and hold harmless Polyform and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of a third party

17. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Sweden. You consent to the personal jurisdiction of such courts.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. We may also notify you via email for significant changes.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you should stop using the Service.

19. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Polyform regarding the Service.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
